Additional Sessions Judge Sandeep Yadav of Saket district court, while dismissing the bail plea, said that being part of the family of the deceased, the accused is in a position to influence the witnesses in the case. The statements of many witnesses of the case are yet to be recorded.
The court also said that Rohit was killed on the first floor and according to CCTV footage Apoorva was the last person to go to the first floor of the house. This entire case is based on circumstantial evidence. In view of the evidence that has just surfaced, the case of murder is made at the first sight on the accused. Apoorva is accused of murder which may also carry the death penalty.
The court noted that Apurva’s lawyer gave full emphasis to the recorded statements of the witnesses and read many statements in the court. The court said that while disposing of the bail plea there is no need to go into the depth of the statements of the witnesses, this may affect the hearing of the case.
Defense counsel Mehmood Pracha said that the statements of 11 witnesses, including several key witnesses, have been recorded and there is no possibility of influencing any witnesses. Rohit’s mother Ujjwala was informed by the police about the murder. Therefore his statement is based on his belief. Her client was most concerned about her husband’s well being.
Opposing the prosecution’s bail plea, Apoorva did not inform the police even after seeing Rohit in a bad condition. On the other hand, Ujjwala Tiwari’s lawyer Tariq Nasir and Manav Narula had said that the relationship between the couple was bad since marriage and Apoorva fights with Rohit over trivial matters.
