The petitioner has also urged the court to empower Lokpal to exercise statutory powers under the CrPC. At the same time, the court has also been asked to declare that the Lokpal will be able to prosecute the leaders-bureaucrats-criminals on the basis of evidence collected for crimes under IPC and other laws. It said, the court may direct the formation of special courts to expedite all such cases. Former Union Home Secretary NN Vohra chaired the committee constituted to study the problem of criminalization of politics and nexus between criminals, politicians and bureaucrats. The committee submitted its report in October 1993.
The report included comments from official agencies on the criminal network. “However, no action has been taken on the findings of the Vohra Committee report in the last 27 years,” the petition said.
The petitioner has requested to direct the Home Secretary to withdraw the Padma Award from all those leaders whose names are in the report of the Vohra Committee. This petition has been filed by advocate Ashwani Kumar Upadhyay. The petition also urged the court to set up a judicial commission to oversee the investigations being conducted by investigative agencies like NIA, CBI, ED, IB, SFIO, RAW, CBDT and NCB.
