Former Bihar Chief Minister and President of Hindustani Awam Morcha (WE) party Jeetan Ram Manjhi was appointed as the Protem Speaker of the Bihar Legislative Assembly on Thursday. Governor Fagu Chauhan administered the oath of office to Manjhi at Raj Bhavan.

According to the statement issued from the Governor’s Secretariat, ‘Governor Fagu Chauhan administered the oath to Jitan Ram Manjhi, MLA from Imamganj, to discharge the duties of the Speaker of the Legislative Assembly. In exercise of the powers conferred by the Constitution of India, the Governor appointed Jeetan Ram Manjhi, a member of the Bihar Legislative Assembly, to perform the duties of the Speaker from 23 to 24 November till the election of the Speaker.

As the Protem Speaker, Manjhi will administer the oath of membership of the House to the Assembly to the newly elected MLAs. It is to be noted that in the first meeting of the cabinet of the government headed by Nitish Kumar on Tuesday, it was decided to convene the first session of the newly formed 17th Assembly and the 196th session of the Legislative Council from 23 to 27 November.

It was also approved to authorize the Chief Minister to approve the draft of the Governor’s address at a joint session of the two Houses. On Monday, a 15-member cabinet led by Nitish Kumar took oath of office and secrecy. Nitish Kumar has become the Chief Minister for the seventh time.

Why is a pro tem speaker appointed
Let the state governor have to call a brief session for a majority test in the assembly. For this, the Protem Speaker (occasional Speaker) has to be appointed. The Protem Speaker has the responsibility to complete the process of proving a majority in the House and to administer the oath to the new MLAs. Subsequently, the ruling party appoints the Speaker of the Legislative Assembly.

Article 180 (1) of the Constitution empowers the Governor to appoint a Protem Speaker (occasional Speaker). This paragraph states that if the chair of the Speaker becomes vacant and there is no Deputy Chairman to fill the post, the duties of the office shall be ‘performed by such member of the Legislative Assembly as the Governor appointed for the purpose. ‘

What is a Protem Speaker
The Protem Speaker is said to be the one who runs the Parliament or the Legislative Assembly until the election of a permanent Speaker or Vice President in the first session after the election. Simply put, the caretaker and the temporary president are the protem speakers. They are short-term elected in the Lok Sabha or the Legislative Assemblies.

Generally, the senior-most member of the House is entrusted with this responsibility. They discharge their duties related to the running of the House temporarily before the election of Speaker or Deputy Speaker immediately after the Lok Sabha or Assembly elections. Protem speakers remain in office until members elect a permanent president.
